JobZooterms and conditions

This page sets out the terms and conditions on which the JobZoo LTD (company registration number 07608402) of C/O WaterFront Solicitors LLP, 14 Weller Street, London, SE1 1QU, Engand shall offer access to its website www.JobZoo.co.uk and provide you with services (referred to as either "services" or "registers user services").

You acknowledge that by accessing this website and/or the services you agree to be bound by these terms. If you do not accept these terms and conditions, do not continue with your use of the website.

General terms and conditions

SECTION A: GENERAL CONDITIONS shall have general application to everyone who accesses and uses the Website. In addition, SECTION B: REGISTERED USER SERVICES shall apply to users of the Registered User Services.

SECTION A: GENERAL CONDITIONS

1. THE WEBSITE

1.1 The Website is owned and managed by The JobZoo Ltd, a company registered in England and Wales with Company Registration Number 07608402 and having its address at C/O Waterfront Solicitors, 14 Weller Street, London, SE1 1QU, England. Our main trading address is 3 Stephendale Yard, 1 Stephendale Road, London, SW6 2LR.

2. PRELIMINARY INFORMATION

2.1 These terms and conditions relate to your use of the Website provided by JobZoo. The Website allows you to view and access information designed to assist and educate you in finding employment. If you register as a Registered User, you will also have the ability to access and customise your own Wall, upload information to create a CV and potentially have the opportunity to connect with employers or recruitment agencies through the Website.

2.2 By using the Website, whether as an unregistered user or a Registered User, you warrant and represent that:

2.2.1 you are legally capable of entering into binding contracts;

2.2.2 you are not in any way prohibited by the applicable law in the jurisdiction in which you are currently located to enter into these Terms; and

2.2.3 if an individual, you are at least 18 years old. If you are under the age of 18, you should ask a parent or guardian over the age of 18 to enter into these Terms on your behalf. As a parent or guardian of someone under the age of 18, you are responsible for ensuring that person’s use of the Website and/or Services is in accordance with these Terms.

2.3 Access to the Website is permitted on a temporary basis, and JobZoo reserves the right to withdraw or amend the Website without notice. JobZoo will not be liable if for any reason the Website is unavailable at any time or for any period.

3. YOUR OBLIGATIONS

3.1 You must only access the Website and use the Services in accordance with these Terms and any instructions which JobZoo may provide to you from time to time relating to such access and use.

3.2 When accessing and using the Website and/or the Services, you may be given the opportunity to submit information, text, images, videos, audio, files, links to external websites and other material of any format to be displayed on the Website, or used by JobZoo to provide the Services to you and others (“Submissions”). All Submissions must:

3.2.1 comply with all applicable laws and legislation;

3.2.2 not infringe any intellectual property rights or other proprietary rights of any third party;

3.2.3 not reasonably be deemed to:

(i) be offensive, illegal, inappropriate or in any way:

(ii) promote racism, bigotry, hatred or physical harm of any kind against any group or individual;

(iii) harass or advocate harassment of another person;

(iv) display pornographic or sexually explicit material;

(v) promote any conduct that is abusive, threatening, obscene, defamatory or libellous;

(vi) promote any illegal activities;

(vii) provide instructional information about illegal activities, including violating someone else’s privacy or providing or creating computer viruses;

(viii) promote or contain information that you know or believe to be inaccurate, false or misleading;

(ix) engage in the promotion of contests, sweepstakes and pyramid schemes, without our prior written consent;

(x) exploit people in a sexual or violent manner;

(xi) invade or violate any third party’s right to privacy; and

(xii) transmit “junk mail”, or “chain letters”, or unsolicited mass mailing, messaging or “spamming”.

3.3 JobZoo does not vet, verify the accuracy, correctness and completeness, edit or modify any of Submissions or any other information, data and materials created, used and/or published by you on the Website to determine whether they may result in any liability to any third party. You hereby warrant that you have the right to use all such information and material.

3.4 Whilst JobZoo aims to publish all Submissions on the Website, JobZoo reserves the right to refuse any such publication whether wholly or partly if JobZoo has reason to believe that your use of the Website and/or Services breaches these Terms.

3.5 You hereby grant JobZoo a non-exclusive, perpetual, irrevocable, worldwide licence to make Submissions available on the Website.

3.6 You shall not:

3.6.1 at any time use the Website and/or the Services with the purpose of impersonating another user or person;

3.6.2 use the information made available to you through your use of the Website and/or Services for any purpose other than for the purposes of procuring benefit out of the Website and/or the Services; and

3.6.3 do anything whatsoever which shall or is likely to impair, interfere with, damage, or cause harm or distress to any persons using the Website and/or Services or in respect of the network.

3.7 JobZoo takes breaches of this clause 3 very seriously and therefore reserves the right to take any action that JobZoo deems necessary. This can include, without limitation, suspension or termination of your use of the Services and/or access to the Website. In certain circumstances JobZoo may choose to instigate legal proceedings as appropriate if there is illegal use of the Services and/or the Website. You shall promptly notify JobZoo if you are aware of any or any suspected breaches of this clause 3 by other users.

4. REGISTRATION

4.1 In order to use the Services as a Registered User, you are first required to register with JobZoo by completing the applicable online registration process on the Website.

4.2 JobZoo shall send you a verification email to confirm your email address and registration. Your contract (“Contract”) to use the Services commences on the date of the confirmation email.

4.3 You warrant that the information you provide to JobZoo in the registration process is true, accurate and correct. You further warrant that you shall promptly notify JobZoo in the event of any changes to such information. By completing the online registration form, you acknowledge and consent to JobZoo conducting verification and security procedures in respect of the information provided in such online registration form.

4.4 You agree to keep your registration details for the Website (“Login Details”) confidential and secure. Without prejudice to the other rights and remedies of JobZoo, JobZoo reserves the right to promptly disable your Login Details and suspend your access to the Services and/or the Website in the event JobZoo has any reason to suspect or believe that you have breached any of the provisions set out in these Terms.

4.5 You agree that you are solely responsible and liable for all activities on the Website and undertaken through or using your Login Details.

4.6 You must promptly notify JobZoo in the event there is any actual or suspected breach of security or any unauthorised use or attempted use of your Login Details. JobZoo may be contacted by email.

4.7 You agree that at all times, you shall:

4.7.1 not use your Login Details with the intent of impersonating another person;

4.7.2 not allow any other person to use your Login Details;

4.7.3 not use the Website, the content therein and/or do anything that will infringe the Intellectual Property Rights as defined in clause 8 or other rights of any third parties;

4.7.4 not use any information obtained using the Services and the Website otherwise than in accordance with these Terms;

4.7.5 co-operate with any reasonable security or other checks or requests for information made by JobZoo from time to time; and

4.7.6 use the information made available to you on the Website and through the Services at your own risk.

5. TERMINATION

5.1 You may request to terminate your Contract at any time by contacting Lizzie Larmour.

5.2 JobZoo shall be entitled to suspend and/or terminate your access and use of the Website and/or the Services:

5.2.1 if JobZoo’s network providers and suppliers cease providing JobZoo with their services;

5.2.2 if JobZoo has reason to believe that you have breached any of the provisions under these Terms;

5.2.3 if JobZoo has reason to believe that you fail to comply with the applicable laws and legislation;

5.2.4 if JobZoo has reason to believe that your Login Details may have been hacked into by a third party and used without your authorisation, in which case JobZoo shall assign you with new Login Details; or

5.2.5 in situations where JobZoo has reason to believe that you have provided JobZoo with false, inaccurate or misleading information when you registered to use the Website and/or the Services.

5.3 Upon termination of your Contract in accordance with clause 5.1 or clause 5.2, you are no longer a Registered User and therefore shall have no further access to the Services. JobZoo shall remove all information including without limitation Submissions to the extent that JobZoo is not bound by any existing law and legislation to retain such information.

6. WARRANTIES AND LIABILITIES

6.1 All warranties, representations, guarantees, conditions and terms, other than those expressly set out in these Terms whether express or implied by statute, common law, trade usage or otherwise and whether written or oral are hereby expressly excluded to the fullest extent permissible by law.

6.2 JobZoo relies on other service providers (such as network provider, data centres, telecommunication providers) to make the Website and the Services available to you. Whilst JobZoo takes all reasonable steps available to it to provide you with a good level of service, JobZoo does not guarantee that the Website or any such service shall be fault free or uninterrupted at all times. JobZoo therefore shall not be liable in any way for any losses you may suffer as a result of delays or failures of the Website.

6.3 JobZoo does not in any way participate in nor shall it be liable in any way for whatsoever reason for any communication, transaction, meet-ups, set-ups or any relationship between you and other Website users, employers or recruitment agencies. JobZoo therefore recommends that you take all safety precautions when contacting, socialising, and engaging in any business transactions or business or social gatherings and meetings with other Website users.

6.4 JobZoo may display links to third party websites and third party advertising banners on the Website. However, JobZoo shall not be responsible and do not accept any liability for the content and your use of such third party links and advertising banners.

6.5 JobZoo shall not be liable for any indirect, special or consequential losses, expectations of a specific nature or anticipated outcome, anticipated savings, loss of profit, loss of opportunity, loss of data, loss of contract, loss of goodwill and reputation, loss of management time, loss of enjoyment, loss of employment benefit or any other loss however arising and whether caused by tort (including negligence), breach of contract or otherwise even if foreseeable arising out of or in connection with your use and/or reliance of the Website and/or the Services.

6.6 Nothing in these Terms shall limit or exclude any liability for death or personal injury resulting from negligence or any liability for fraudulent misrepresentation.

7. RELIANCE ON INFORMATION POSTED

7.1 JobZoo endeavours to ensure that the information posted on the Website is as helpful and useful to you as possible. However, JobZoo can not vet, verify the accuracy, correctness and completeness, monitor, edit or modify all of the content on the Website. Consequently, all information and content available on the Website is provided to you “as is” and you agree that any use made by you of such content shall be strictly at your own risk. JobZoo disclaims all liability and responsibility arising from any reliance placed on such materials by any visitor to our site, or by anyone who may be informed of any of its contents.

8. INTELLECTUAL PROPERTY RIGHTS

8.1 JobZoo and its licensors own all rights in the intellectual property rights relating to the Website and the Services. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

8.2 You may print off copies and you may download extracts of any pages from the Website solely for your personal use; and you may send or forward page links to the Website to others.

8.3 JobZoo’s status (and that of any identified contributors including other Users) as the author of the materials on the Website must always be acknowledged. You must not use any part of the submissions of other users and all materials on the Website for commercial purposes.

9. DATA PROTECTION AND PRIVACY POLICY

9.1 You and JobZoo shall comply with the Data Protection Act 1998 and all other successor legislation and regulation in the performance of the obligations set out under these Terms.

9.2 JobZoo processes your personal data (as such term is defined in the Data Protection Act 1998) in accordance with its Privacy Policy which is accessible by clicking here. The terms of the Privacy Policy form part of these Terms and you agree to be bound by them.

10. LINKING

10.1 You may link to the Website’s home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

10.2 The Website must not be framed on any other site, nor may you create a link to any part of the Website other than the home page. We reserve the right to withdraw linking permission without notice. The website from which you are linking must comply in all respects with all applicable Terms.

10.3 Where the Website contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

11. VIRUSES, HACKING AND OTHER OFFENCES

11.1 You must not misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Website, the server on which the Website is stored or any server, computer or database connected to our site. You must not attack the Website via a denial-of-service attack or a distributed denial-of service attack.

11.2 By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. JobZoo will report any such breach to the relevant law enforcement authorities and will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Website will cease immediately.

11.3 JobZoo will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Website or to your downloading of any material posted on it, or on any website linked to it.

12. GENERAL

12.1 If JobZoo fails at any time to insist upon strict performance of its obligations under these Terms, or if it fails to exercise any of the rights or remedies to which it is entitled to under these Terms, this will not constitute a waiver of any such rights or remedies and shall not relieve you from compliance with such obligations.

12.2 A waiver by JobZoo of any default shall not constitute a waiver of any subsequent default. No waiver by JobZoo of any of these Terms shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

12.3 All notification and communication to JobZoo should be sent to the contact details made available to you on the Website.

12.4 If any of these Terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent, be severed from the remaining terms, conditions and provisions which shall continue to be valid to the fullest extent permitted by law.

12.5 These Terms represent the entire agreement between you and JobZoo in respect of your use of the Website and shall supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

12.6 You acknowledge that in entering into these Terms, you have not relied on any representations, undertaking or promise given by or implied from anything said or written whether on the Website, the Internet or in negotiation between us except as expressly set out in these Terms.

12.7 JobZoo may update or revise these Terms from time to time and shall notify you of any such updates and revisions through a message displayed on the Website. Your continued use of the Services and/or the Website (whether wholly or partly) shall be deemed your acceptance of such change(s) in respect of the updated or revised Terms. If you do not agree with the changes to these Terms, you may terminate your Contract with us in accordance with clause 5.

12.8 These Terms shall be governed by and construed in accordance with English law and the English courts shall have exclusive jurisdiction. If you live outside the UK, English law shall apply only to the extent that it does not deprive you of any legal protection accorded under the law of the place where you are habitually resident. If English law deprives you of any legal protection which is accorded to you under your local law, these terms will be governed by your local law and any dispute or claim arising out of or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts where you are habitually resident.

Section B: registered users

This section B shall apply to all Registered Users who register with the Website to access the Registered User Services.

B1. REGISTERED USER SERVICES

B1.1 Your Contract with JobZoo for the provision of the Registered User Services shall commence on the date of confirmation of your registration in accordance with clause 4 of these Terms.

B1.2 Notwithstanding the foregoing, JobZoo reserves the right to:

B1.2.1 accept or reject your application as a Registered User; and

B1.2.2 refuse you access to the Registered User Services and/or Website (partly or wholly) if you breach any of these provisions.

B1.3 JobZoo shall provide you with the Registered User Services free of charge in consideration for your compliance with these Terms. The Registered User Services shall comprise the following:

(i) the ability to create, customise and contribute materials to a personalised page (your “Wall”);

(ii) the facility to enter data to create your personal Curriculum Vitae listing your personal details, academic background, work experience, employment history and other information (“Registered User CV”); and

(iii) subject to clause B1.4, providing your Registered User CV to third parties such as employers or recruitment agencies from time to time.

B1.4 During the Registered User registration process or at any time subsequently, you may ‘opt-in’ to permit JobZoo to share your Registered User CV with third parties. If you opt-in to this service, you authorise JobZoo to make your Registered User CV you create through the Website available to such third parties for the purpose of determining if you would be suitable for any employment vacancies or programs offered by that third party. You also authorise and consent to JobZoo providing your contact details to such third parties for the purpose of contacting you regarding such employment or services.

B1.5 Subject to clause B1.4, JobZoo shall keep confidential all information (including but not limited to your Registered User CV), stored and retained by you using the Registered User Service subject to any legal and/or statutory requirements on JobZoo to disclose any information about you.

B2. YOUR ADDITIONAL OBLIGATIONS AS A REGISTERED USER

B2.1 You shall at all times use the Registered User Services in accordance with these Terms and strictly for your personal use only.

B2.2 You are solely responsible for the use of the Registered User Service and, if you opt-in to the sharing of your Registered User CV in accordance with clause B1.4, for all communication and/or employment discussions with third parties.

B2.3 In using the Registered User Services, you shall:

(i) provide information necessary to complete your Registered User CV including without limitation your identity, your qualifications, skills, training and experience and confirmation that you have the right to work in England and Wales;

(ii) not provide information (including in your Registered User CV) which you know to be inaccurate, false, incomplete, untrue or is or may be deemed to be a misrepresentation of your personal details, employment history or any other facts; and

(iii) exercise caution and take care not to breach the provisions in your existing employment contract or any other contractual obligations you may have when you are in discussions for employment with any employers or recruitment agencies.

B2.4 In the event JobZoo does connect you with any third party employer or recruitment agency, you will also be responsible for:

(i) ascertaining the identity of the any employers or recruitment agencies;

(ii) ensuring that you have the qualification, skills, training and experience requested in the job specification for any employment vacancies;

(iii) all information provided to the employer including without limitation your Registered User CV and all other supporting documents; and

(iv) ensuring that you have the right to work in England and Wales.

B3. ADDITIONAL WARRANTIES

B3.1 You acknowledge and agree that when you use the Registered User Services, JobZoo does not guarantee that you will:

(i) find vacancies suitable to your specific qualifications, skills, training and experiences;

(ii) secure interviews with employers or recruitment agencies;

(iii) secure a job; and

(iv) achieve any specific results whatsoever.

B3.2 You acknowledge and agree that whilst JobZoo does review details of employers and take steps to ensure the information is helpful and as accurate as possible, JobZoo can not as a rule vet or verify the identity of all third parties it may share your Registered User CV with (including employers or recruitment agencies). Consequently, JobZoo does not warrant or guarantee:

(i) the currentness, completeness, correctness and accuracy of the information posted on the Website;

(ii) that any employment vacancies, internships, programs or other work opportunities are genuine; and

(iii) the identity of third parties such as employers or recruitment agencies using the Website.
